A D.C. Superior Court judge has permanently dismissed the criminal case against former Olympic slalom canoeist David Hearn — in a way that prevents prosecutors from ever reviving it. Judge Todd Edelman dismissed the felony destruction of property charge against Hearn with prejudice on October 1, a ruling that bars the Department of Justice and U.S. Attorney Jeanine Pirro’s office from refiling the same case.

Hearn, 67, was originally indicted by the DOJ in July 2026 on a charge of felony destruction of federal property related to an incident at the Lincoln Memorial Reflecting Pool. The indictment alleged property damage valued at more than $1,000, meeting the felony threshold under D.C. law. Judge Edelman’s October 1 order dismissed those charges with prejudice.
