Silencer Rules Changed: What ATF's New Guidance Means for Suppressors

If you're thinking of buying a suppressor, the rules changed on October 9. ATF says it will no longer enforce federal approval, registration or tax-stamp requirements for suppressors and certain other weapons. But federal background checks and state laws still apply.

Effective October 9, 2026, ATF will not enforce the requirements for individuals to apply and receive approval before making or transferring suppressors, short-barreled rifles, short-barreled shotguns and certain "any other weapons." ATF also will not enforce the National Firearms Act's registration, tax-stamp or related requirements for those covered items. The guidance follows a court ruling, though the specific court order and its full legal scope were not independently verified in the material reviewed.

Buyers should know what still applies. These items remain statutory firearms under the Gun Control Act. Licensed dealers must still complete an ATF Form 4473 and run a National Instant Criminal Background Check System check before transfer. State and local laws are unaffected, and ATF will continue to process NFA applications where a state requires registration. Machine guns and destructive devices remain fully subject to the NFA, including the $200 tax.

Did the court strike down federal suppressor registration?

ATF's guidance says it will no longer enforce NFA approval, registration and tax-stamp requirements for suppressors and the other covered items. The agency describes the ruling as resting on Congress reducing the relevant tax to $0 and the court's constitutional analysis of the taxing and commerce powers. The draft's earlier claim that the ruling turned on the Bruen historical-tradition test was not supported.

  • ATF Form 20 approval for interstate transport of short-barreled rifles and shotguns.

Why this is easy to misread

Some outlets blur "ATF will not enforce" with "the law is gone." Those are different things. The NFA provisions remain on the books; ATF has chosen not to enforce them for the covered items. That distinction matters for anyone relying on the guidance.
